Question: help!!!!! with benefit fraud accusation!!!!!???

a year ago i had to have a interview under caution regarding reciveing to much council and housing benefit. this happenend because of one wftc (working families tax credit) document i forgot to send off (yes i really did i under no circumstance agree with benefit fraud!!)
so i paid off the council tax overpayment , and stilll paying the housing overpayment off which should be finished the end of this year.
all this was last may (2007)
today i get a letter from solicitors for a court date saying i had not not turned up for an administrative penalty interview.
i had no letter about it, on the solicitors letter it has my wrong house number on (from my privous address) so i’m guessing it got sent there.
i have written a letter to the courts and solicitors about this and going to cab next week, but has this happen to anone?
i’m worried sick that i’ll get a criminal record.

Answer: I was taken to court for benefit fraud in 2002. They said I was working illegally whilst claiming benefits. I was on a training scheme that they had set up themselves and made a pig’s ear of it. It was a scheme where you got your benefits plus £10.
It went to court and their solicitor was the dopiest prat I’d ever met. They had no correct information, files were missing, nobody knew anything. It was quite comical really.
I had an Asian barrister who tore them to strips and showed them up to be spiteful, incompetent, and clueless. It was thrown out and I awarded costs.
So, please don’t lose any sleep over this. You made a genuine mistake by the sound of it.
The WFTC is notorious difficult to understand unless you are Gordon Brown who introduced it, or an illegal immigrant ripping it off due to complexities.
Get a solicitor or the CAB to help you. Don’t be frightened of going to court because they are more understanding than the DWP and they will have come across this situation before now.
The fact you’ve paid back nearly all this over-payment will stand you well. Just keep a record of all future phone calls and letters from them.

Tax Credit Overpayments

Question: tax credits overpayment! again! ?

2 years ago they overpaid me by £1400 which im still paying back. Now they have just written to me again saying i owe them another £477 from April 07 till Dec 07, this was nearly a year ago. Why do they keep doing this too me? im already paying back £100 a month and cant afford any more. its so frustrating i thought they were supposed to help people not keep getting them in debt. Theyu say there is nothing they can do about it but surely there is? they cant even tell me why it was overpaid. what can i do?




Answer: Go to your local CAB they will write a letter for you to them, they are pretty good at getting over payments over turned. If it was an error on their side then they should admit their fault and not charge you. Good luck

Tax Credit Overpayment

Question: has anyone had an overpayment on their tax credits,if so what happened and did u have 2 pay it back?




Answer: Because hubby and I are self employed and they give us our tax credit on what they think we will make next year based on what we made this year, we got hit pretty hard. We made a rubbish profit a couple of years ago so last year they gave us some money. We then made a good profit last year and because we did they demanded all the money back that they had given us. Because this year’s is based on the good profit we made last year, we get nothing. So we are paying it all back in monthly installments.
If we make a rubbish profit this year, then theoretically they owe me for what they haven’t given me plus what they assume I will make next year. But I daren’t spend it in case they demand it all back the year after!!

It’s all so complicated and a totally stupid system, especially for the self employed.
