Question: Ex Filed BK on Marital debt?

My ex was assigned monies owed to me in our divorce 7 years ago,he never paid. I have a lien against the land he owns and a writ of execution was brought forth to sell this asset to satisfy the debt. Mind you, he owns this land outright and recently tried to sell it for 1 million dollars.

Anyway, the day before the sheriffs we’re to auction off the property, he filed bankruptcy.

My question is, can a marital debt( money judgment) be discharged?

BTW: This is in california. I paid his portion of the debts he was ordered to pay in the divorce ( taxes,credit cards etc.) to protect my credit. Then I had to go back to court to show the judge I paid them to get a judgment for a dollar amount.

Answer: In a bankruptcy, all claimants of money or other debt owed are notified and can be heard before the bankruptcy is finalized. This is the chance they get to object to their claims being negated by the action.
