Question: I am planning to apply for spouse visa for my spouse in Nigeria.?

I am planning to apply for spouse visa for my spouse in Nigeria to bring him over to the UK. I am a british citizen. I have always worked full time but I have been claiming, Working tax credit, child benefit and Disability living allowance for my son.

Answer: Not necessarily. You are perfectly entitled to claim any benefits for which you are eligible. The important thing is to be ale to prove that you can support your spouse without recourse to public funds. Your spouse’s presence in your household must not increase your reliance on benefits and you must be very careful not to claim a penny on his behalf or because he is living with you.

As a guide you will need to show that you have £105 left over per week from your income after rent, council tax and utilities. Add to that £56 per week per child.

If you are in rented property you will need the written permission of your landlord consenting to your husband living in the property with you.

You will also have to provide him with three to six months of your bank statements, pay slips and your employment contract.

Also include evidence of contact such as plane tickets, email logs, phone bills etc. You should also write a letter of support for his application outlining the history of the relationship.
