New Tax Credit For Home Purchase

Question: California Tax Credit for New Home Purchase?
We are looking a buying a new home that would qualify for the $10000 tax credit but the home is now bank owned. Can the bank fill out the first part of the form that the builder normally would fill out to certify that the house has never been occupied or would it no longer qualify for the credit?
