Question: Legal help needed please!!!?
My fiance and I were about to buy our first home – $260K. After we found our dream house, we spent about 2 months negotiating, getting paperwork in order, etc. Finally we signed the contract (and so did the seller) and we paid our earnest money. We also gave notices to our respective apartments that we are moving out. We submitted a lifetime worth of paperwork to the bank to get approved for a loan.Yesterday, we get an email from seller that he has changed his mind and wants to settle this amicable out of court. Looks like we are also going to miss the $8,000 tax credit incentive. Our situation is aggravated by the fact that we have 3 pets and there are very few apartments, if any, that allow 3 pets. What are we entitled to? What amount is reasonable to ask for, as a compensation?

1) You made justifiable reliance on the sellers contract that you both signed
2) He has breached the contract
3) The remedy for your damages fall into the categories of equitable and legal

Question: Do I qualify for the $8000 New Home Buyer Tax Credit?
I was married to someone who was already a home owner and was not named on the mortgage, deed etc but we did live together in the home for several years. We separated in 2007 and were legally divorced in 2008. Will I qualify for the tax credit if I purchase a home?
Answer: I spoke to the IRS about this question. The short answer is….probably not. When you got married the home also became yours. Assuming you filed a joint return while married and helped with mortgage payments in some way then you were considered a home owner until your divorce. In a few states this would not be the case but for the most part the IRS would have serious questions that would need to be answered and you would have to prove that you never assisted with mortgage payments or benefited from decreased taxes when you filed a joint return.
However, if you are buying the home with someone who does meet the definition of a first time home buyer then that person may claim the credit even if you are not able to.
